(Scope of Application)
Article 1. These Terms and Conditions shall apply to all cases in which the Nankai limited express ticketless service provided by Nankai Electric Railway Co., Ltd. (hereinafter the “Company”), that does not require registration, is used.
(The Service)
Article 2. Users can purchase special express tickets, seat reservation tickets, and special carriage tickets (hereinafter “Limited Express Tickets”) using the internet environment provided by the Company. (Hereinafter the “Service”)
(Information Registered When Purchasing Limited Express Tickets)
Article 3.1. The following information should be entered when purchasing Limited Express Tickets using the Service:
(1) Name
(2) Date of birth
(3) Email address
(4) Credit card details
2. The Company shall send Limited Express Ticket purchase information from club@nankai.co.jp to the email address referred to in the preceding paragraph. Users who restrict delivery of email should configure their email settings to enable email to be received from the above-stated email address by adding the domain or email address to an approved sender list.
3. Credit card details referred to in paragraph 1 can only be entered if the expiry date is after the departure date for the tickets being purchased.
(Definition of Terminology)
Article 4. The meaning of terms used in these Terms and Conditions shall be as follows:
Users: Persons who agree to these Terms and Conditions and use the unregistered Nankai limited express ticketless service via the internet environment
Limited Express Ticket: Limited Express Tickets sold through the Service
PCs: PCs with an internet connection
Information Devices: Information devices such as internet-enabled smart phones (excluding some devices)
Website: Nankai limited express ticketless service website
Limited Express Tickets Purchasing Information: Ticket number, travel date, train name, departure station, departure time, arrival station, arrival time, number of passengers, carriage number, seat number, purchase price, payment method
(Responsibility of Users)
Article 5.1. When using the Service, Users shall be fully liable for registered email addresses and the management of Limited Express Tickets Purchasing Information sent by the Company.
Users shall be liable for registration operations they conduct, irrespective of whether they register the information themselves and irrespective of any negligence. Users shall resolve, at their own responsibility and expense, any disputes with another party in the event that damage is caused to other Users or non-user third parties when Users use the Service.
2. The Company shall demand that a User compensate for all damage suffered in the event that a User violates these Terms and Conditions and damage is caused to the Company, and the User shall comply with such demand.
(Change to Notified Matters)
Article 6. Users may not change their name, date of birth, email address, or credit card details notified to the Company; provided, however, excluding changes to Limited Express Tickets Purchasing Information (train changes, ticket redemption, etc.).
(Time Limit for Confirming Limited Express Tickets Purchasing Information)
Article 7. The time limit for Users to confirm Limited Express Tickets Purchasing Information after purchasing Limited Express Tickets shall be up until the date on which the limited express train for which tickets have been purchased leaves the departure station.
(Restrictions on Use of the Service)
Article 8.1. Users are liable for putting restrictions in place, such as processing refunds using a different Information Device, etc. in the event that restrictions on use of the Service are necessary due to the theft or loss of an Information Device.
2. The Company shall not be liable for any impediments that arise in the use of the Service as a result of actions taken in accordance with the preceding paragraph.
(Loss of Eligibility to Use the Service)
Article 9. The Company may erase registered details without notifying Users in advance when Users correspond to any of the following cases:
(1) When Users violate these Terms and Conditions
(2) When Users are judged to be unsuitable by the Company such as when a User’s use of the Service is likely to cause damage to the Company
(3) When Users have used the Service illegally
(Contact Desks and Hours)
Article 10. The contact desk that handles the Service and handling hours shall be in accordance with that determined separately by the Company.
(Purchase of Limited Express Tickets)
Article 11.1. Users may purchase Limited Express Tickets from Information Devices and PCs by entering the information referred to in Article 3.1. In such case, upon completion of payment procedures, the Company shall send Users an email containing Limited Express Tickets Purchasing Information to the email address registered by Users.
(However, tickets cannot be purchased for unaccompanied children.)
2. Limited Express Tickets may be purchased, Limited Express Tickets Purchasing Information may be checked, and limited express seat availability may be verified between 3:00 AM and 2:00 AM Japan Standard Time (JST).
3. Limited Express Tickets can be purchased from 10:00 JST one month prior to the departure date for the limited express train concerned until three minutes prior to the time the train departs from the departure station.
4. When reserving seats, Users may select seats from a seat chart. Alternatively a window, aisle, regular or super seats, etc. may be selected automatically. Another seat will not be offered and a message such as “The following seat cannot be reserved.” will be displayed when it is not possible to reserve a requested seat.
5. Users may purchase up to eight seats on one train when purchasing Limited Express Tickets; provided, however, that when purchasing multiple seats, such seat must be in the same carriage.
6. Users should separately purchase, using the Service, etc., additional seats on the same train as Limited Express Tickets purchased through the Service.
7. The Company shall send an email containing Limited Express Tickets Purchasing Information to the email address registered by Users. The Company shall not be liable if emails from the Company cannot be received due to Users entering incorrect email addresses or email settings rejecting emails, etc., and impediments arise in the use of the Service.
(Limited Express Tickets Payment Method)
Article 12.1. Limited Express Tickets purchased using the Service must be paid for using a credit card. Accepted credit cards are listed below; provided, however, that credit cards cannot be registered unless the expiry date on the card is after the departure date for the tickets being purchased.
(JCB, VISA, Master, AMERICAN EXPRESS, Diners Club)
2. Credit card payments cannot be made in installments.
3 The Company conducts credit references with credit card companies based on registered credit card information, etc.
4. Limited Express Tickets cannot be purchased if a registered credit card cannot be used due to the card having been canceled or communication errors, etc.
5. The Company shall not be liable for any impediments that arise in the use of the Service as a result of each of the preceding items.
(Timing of Establishment of Contracts and Applicable Rules)
Article 13.1. Transportation contracts, etc. based on the Service shall come into effect in the following situations:
(1) When Users have conducted procedures themselves using Information Devices or PCs, and the Company’s system has sent Limited Express Tickets Purchasing Information to Users after assigning seat numbers, etc. (the same condition applies when redeeming tickets)
(2) When Users have been issued with vouchers for the contract such as tickets, etc. (in this case, these shall be handled in the same way as special express tickets, seat reservation rickets, and special carriage tickets set forth in Passenger Operations Regulations established by the Company)
2. Unless otherwise specified, all handling after a contract has been established in accordance with the provisions of the preceding paragraph shall be in accordance with such provisions when such the contract is established.
(Boarding a Limited Express Train)
Article 14.1. Users must take an Information Device that can confirm a record of purchases by the User when purchasing Limited Express Tickets and boarding a limited express train.
2. Users should use their Information Device to present purchase information such as seat numbers upon request by Company staff. Users may not be allowed to board the train if purchase information cannot be confirmed due to an Information Device running out of battery or malfunctioning.
(Changing Limited Express Ticket Trains)
Article 15.1. Requests to change trains after purchasing Limited Express Tickets using the Service will be handled if there are limited express seats available on another limited express train. In such case, changes cannot be made to the number of seats purchased, or adult/child ticket categories.
2. Differences in the price of Limited Express Tickets as a result the changes referred to in the preceding paragraph shall be charged or refunded.
3. Changes of train shall be handled up to three minutes prior to the time of departure from the departure station of the limited express train for which tickets have been purchased and the limited express train Users wish to travel on.
4. Users should talk to staff on trains if wishing to change a section on which Users will travel while on a train after the limited express train for which tickets have been purchased has departed. If there is a difference in limited express fares in such case, the difference shall be charged separately if there is a shortfall. The difference shall not be refunded if there is an excess.
5. Limited Express Ticket train changes may only be made twice; provided, however, that Users cannot change Limited Express Ticket trains to a train that departs on a date after the date on which a registered credit card expires.
(Refunding Limited Express Fares)
Article 16.1. The cost of Limited Express Tickets purchased using the Service that are no longer required may be refunded in ticket seat units if canceled using an Information Device or PC by three minutes prior to the time of departure from the departure station of the limited express train for which tickets have been purchased; provided, however, that tickets cannot be redeemed when multiple seats have been purchased if only tickets for children will remain as a result of redeeming tickets in seat units.
2. Fees per seat for redeeming tickets in accordance with the preceding paragraph shall be charged as follows:
(1) Up to two days prior to the date of departure: 30% of the amount already paid (2) Up to the time of departure: 50% of the amount already paid
3. Fractions less than 10 yen in the fees referred to in the preceding paragraph shall be rounded off.
4. Limited express fares shall be refunded in full automatically to registered credit cards if tickets have been purchased for a train that is canceled due to an accident, etc. In such case, refunds may take approximately two days
5. Emails will be sent to registered email addresses notifying of refunds if refunds are made in accordance with the preceding paragraph.
(On-board Checks by Staff)
Article 17. Staff may ask Users their name and ticket number, etc. in order to check Limited Express Tickets while on-board a train.
(Confirming Limited Express Tickets Purchasing Information)
Article 18. Limited Express Tickets Purchasing Information can be checked using Information Devices and PCs.
Users can check information by entering their ticket number and departure date (stated in the Limited Express Tickets Purchasing Information sent by the Company) and their registered email address on the Website’s page for Services Not Requiring Registration (Purchase Information Inquiries).
(Handling Personal Information)
Article 19 The Company shall not disclose, without the consent of the user, the personal information of the user obtained in the process of using the Service to any party other than the Company and the subcontractor with whom the Company has signed a non-disclosure agreement. However, the user agrees in advance to the provision of personal information by the Company in the following cases:
(1) When required by law
(2) When it is necessary to protect a person's life, body, or property and is difficult to obtain the consent of the individual
(3) When it is particularly necessary to improve public health or promote the sound development of children and is difficult to obtain the consent of the individual
(4) When it is necessary to cooperate with a national agency, local government, or a person contracted by the agency or government to carry out affairs stipulated by laws and regulations, and when obtaining the consent of the individual may interfere with the performance of the relevant affairs
(5) When the third party is an academic research institution etc. and the third party needs to handle personal data for academic research purposes (However, this excludes cases where there is a risk of unjustly infringing on the rights and interests of individuals even if the purpose of handling the personal data is partly for academic research purposes)
(Consent to Receive Emails While Using the Service)
Article 20.1. The Company shall send emails when providing information on the Service, and Users shall consent to receive such emails.
2. Transmissions referred to in the preceding paragraph shall be limited to when Users have valid Limited Express Tickets Purchasing Information.
(Communication Costs Relating to the Service)
Article 21. Users shall be liable for Information Device and PC, etc. communications costs involved in the use of the Service.
(Service Suspension and Discontinuation)
Article 22. The Company may suspend or discontinue operating the Service, without notifying Users, in the following situations:
(1) When performing Service system maintenance routinely or in emergencies
(2) When it is no longer possible to provide the Service as normal due to war, riots, earthquakes, fires, power outages, or other emergency situations
(3) When suspension or temporary discontinuations are otherwise deemed necessary for the operation of the Service
(Internet Environment)
Article 23.1. To protect User information, the Service incorporates an encryption function on some pages for browsers used by Users to access the Service using Information Devices and PCs. User should check their browser’s security settings (SSL) if a screen does not display properly. Settings vary depending on each User’s environment. Users should contact their provider regarding specific details relating to this paragraph.
2. The Service may not be available depending on the type of Information Device or PC used by Users and the security level supported by browsers.
(System Failures)
Article 24.1. The Company shall not be liable for any damage, etc. caused by failures in telecommunications carrier or provider circuits or systems, etc. used by the Users to access the Service.
2. The Company shall not be liable for detriment, etc. to Users when the Service cannot be used due to system failures, etc. at the Company.
(Changes to Terms and Conditions)
Article 25. The details of services referred to in these Terms and conditions may be changed, revised, or abolished without notice.
(Company Exemptions)
Article 26.1. The Company shall not be liable for whether information sent by Users arrives in the Company’s system, or whether information that arrives at the Company is the same as information sent by Users.
2. Unless otherwise specified, the Company shall not be liable for Service provision delays, alterations, suspensions, discontinuations, access restrictions, or abolition, or other damage to Users, etc. or third parties that arises in relation to the Service.
3. Users shall be responsible for settling disputes that arise between Users or between Users and third parties in relation to the use of the Service, and the Company shall not be in any way liable in relation to any such disputes.
(Governing Law)
Article 27. This Agreement is governed by the laws of Japan.
(Exclusion of Anti-social Forces)
Article 28. Users represent that they are not an organized crime group or any other anti-social force, that they do not have relations with an anti-social force, and that they are not controlled or influenced by an anti-social force, and Users warrant that they shall not correspond to such in the future.
(Court with Jurisdiction)
Article 29.1. Users and the Company shall consult in good faith if any disputes arise between the User and the Company in relation to the Service.
2. The Osaka District Court shall be the exclusive court with jurisdiction if disputes cannot be resolved through consultation.
